Product License

THIS LICENSE AGREEMENT is a legal agreement between you (the person or organization who has or is purchasing a phpVideo Hosting Engine product) and CyberGeek's Software Solutions for the phpVideo Hosting Engine software product. An amendment or addendum to this License may accompany the Product. YOU AGREE TO BE BOUND BY THE TERMS OF THIS LICENSE AGREEMENT BY PURCHASING, INSTALLING, COPYING OR OTHERWISE USING THE PRODUCT. IF YOU DO NOT AGREE, DO NOT PURCHASE, INSTALL, COPY OR USE THIS PRODUCT.

• GRANT OF LICENSE

  CyberGeek's Software Solutions grants you the following rights provided that you comply with all terms and conditions of this License Agreement.

  • Installation and Use

    You may install the amount of copies allowed by the license you purchased. The amount of copies per license type are listed here: Branded Single License and Unbranded Single License allows up to one copy of the software to be installed; Branded Multi-License and Unbranded Multi-License does not have a restriction on the amount of installation per license. Each license must be installed on the provided domain name and internet protocol address during purchase.

    You may use this software in any form as long as it is within the terms and conditions of this license agreement.

  • Copying, Reproducing, Reproduction, Distribution

    You may not copy, reproduce and or distribute this license to anyone or any third party organization without the written consent of CyberGeek's Software Solutions.

  • Adding, Modifying, Removing of Source Code

    By adding, modifying and or removing source code due to updates within the phpVideo Hosting Engine product, installing available plugins and or changing the skin/template/design of the phpVideo Hosting Engine that have been published by CyberGeek's Software Solutions will not void warranty.

    By adding, modifying and or removing source code from this application you will void warranty and will only be able to obtain support via the phpVideo Hosting Engine Support Forums. However, hiring CyberGeek's Software Solutions will not void warranty if CyberGeek's Software Solutions is to add new source code, modify existing and or remove existing source code from the phpVideo Hosting Engine.

• VALIDATION

  The phpVideo Hosting Engine product will from time to time validate the software license. Validation verifies that the software has been activated and is properly licensed.

  During the validation check, phpVideo Hosting Engine product will send information about the software and the device to CyberGeek's Software Solution. The information includes the version, product or license key and the Internet protocol address of the device. CyberGeek's Software Solution does not use this information to identify or contact you. By using this software, you consent to the transmission of this information.

  If, after a validation check, the software is found not to be properly licensed, the functionality of the software may be affected. For example, you may:

  • Contact CyberGeek's Software Solutions to reactive this software,
  • or you may not be able to use or continue to use the software.
• SCOPE OF LICENSE

  The phpVideo Hosting Engine is licensed, not sold. This agreement only gives you some rights to use the software. CyberGeek's Software Solutions reserves all other rights. You may not:

  • work around any technical limitations in the software;
  • reverse engineer, decompile or disassemble the software, except and only to the extent of this license agreement;
  • make more copies of the software than specified during purchase of this license;
  • publish the software for others to copy; or
  • rent, lease or lend the software.
• BACKUP COPY

  You may make one backup copy of the phpVideo Hosting Engine product at any time to reinstall, or replace changes that have been made to the phpVideo Hosting Engine product.

• NOT FOR RESALE SOFTWARE

  You may not sell the phpVideo Hosting Engine product at any time without the written consent of CyberGeek's Software Solutions.

• PROOF OF LICENSE

  If a problem is encountered with your license, and or CyberGeek's Software Solutions believes that the phpVideo Hosting Engine product you currently are running is not a valid license, you must provide accurate proof that you have purchased the phpVideo Hosting Engine product license. Required information will include: Full Name, Address, Email Address, Domain Name, Server Internet Protocol Address, and the License/Product Key.

• REASSIGN TO ANOTHER DOMAIN & INTERNET PROTOCOL ADDRESS

  At any time, you can request to reassign the license/product key to another domain name and internet protocol address.

• SUPPORT SERVICES

  CyberGeek's Software Solutions makes available to you a variety of support services which include but not limited to:

  • Email Support via support@phpvideoengine.com;
  • A community driven support via Support Forums; and
  • Support and How to Documents.

  If you are using phpVideo Hosting Engine which is not properly licensed, you will not be entitled to receive support services.

• USE OF INFORMATION

  You agree to allow CyberGeek's Software Solutions to log and keep records of all personal information that was received during the purchasing of a phpVideo Hosting Engine product license. CyberGeek's Software Solutions agrees not to sell, reproduce and or distribute this information to anyone or any organization other then partners such as LongTail Video without the written consent from you. This information is used for logistics and enhancing the phpVideo Hosting Engine product to help serve you better.

• ENTIRE AGREEMENT

  This agreement (including the warranty below), additional terms and the terms for supplements, and updates that you use, are the entire agreement.

• APPLICABLE LAW

  If you acquired the software, Ontario, Canada province law governs the interpretation of this agreement applies to all claims, regardless of conflicting laws and principles.

• LIMITATION ON AND EXCLUSION OF DAMAGES

  You can recover from CyberGeek's Software Solutions only direct damages up to the amount you paid for the phpVideo Hosting Engine license that is a valid license and the warranty has not been voided. You cannot recover any other damages, including consequential, lost profits, special, indirect or incidental damages.

• LIMITED WARRANTY

  CyberGeek's Software Solutions will provide limited warranty for the phpVideo Hosting Engine product license within the first ninety days of purchase. This warranty is valid if in the event of initial defects within the phpVideo Hosting Engine product. CyberGeek's Software Solutions will only provide a new fresh copy at no charge to you.

  This limited warranty is only valid if there has not been a license agreement breach.

  NO REFUNDS WILL BE PROVIDED DUE TO ANY WARRANTY CLAIMS.
